g) Expor a figura de seu paciente como forma de divulgar técnica, método ou resultado de tratamento, ainda que com autorização expressa do mesmo, ressalvado o disposto no art.10 desta resolução;

The Use of Patient Images in Medical Disclosure

The Use of Patient Images in Medical Disclosure

Dr. Gustavo Graça Mercadante

He has been a lawyer since 1984, specializing in the Defense of Health Professionals, working in Litigation, Arbitration and Private Mediation.

The dissemination of patient images is a topic of interest and relevance for doctors of all specialties; due to social media, images have gained a lot of relevance in the communication between the doctor and people with whom he interacts, no matter if they are professional colleagues, patients, future patients and even the lay audience.

In Article 5, of the Constitution of the Federative Republic of Brazil of 1988 the following is found:

Art. 5. All persons are equal before the law, without any distinction whatsoever, Brazilians and foreigners residing in the country being ensured of inviolability of the right to life, to liberty, to equality, to security and to property, on the following terms:

…

X - the intimacy, private life, honor and image of people are inviolable, ensuring the right to compensation for material or moral damage resulting from their violation; [our own highlights]

The Brazilian Civil Code - Law No. 10,406, of January 10, 2002, provides the following:

Art. 11. With the exception of the cases provided for in law, the rights of the personality are relatable and unrelatable, and may not be allowed to exercise voluntarily limitation.

…

Art. 20. Except if authorized or necessary for the administration of justice or the maintenance of public order, publication of writings, transmission of speech, and publication, exhibition, or use of the image of a person may be prohibited at the request of the person and without prejudice to any indemnification to which the person may be entitled, if they affect the honor, the good reputation, or the respectability of the person or if they are intended for commercial purposes [our highlights]

Article 75 of Code of Medical Ethics says:

The doctor is prohibited from:

Art. 75. Referencing identifiable clinical cases, show their patients or their photos in professional advertisements or in the dissemination of medical matters, in the media, even with the patient's authorization. [our highlights]

In addition, article 3 of Resolution CFM 1974/2011 says:

Art. 3. The doctor is prohibited from:

g) Showing the image of his/her patient as a way of disclosing technique, method or treatment result, even with his/her express authorization, except for the provisions of article 10 of this resolution;

Art. 10 In scientific works and events in which the exposure of the patient's figure is essential, the doctor must obtain prior express authorization from the patient or his legal representative.[our highlights]

Thus, the Law, including the Federal Constitution states a clear rule regarding the preservation of intimacy and consequent duty to indemnify, when photos of patients are published without their express authorization.

On the other hand, CFM  decided to edit a specific rule, in the sense of prohibiting doctors the right to publish photos of patients, except in scientific works and with their express authorization.

Brazilian jurisprudence is abundant in producing condemnations regarding the use of photos, for commercial purposes, by anyone, without the written authorization of the photographed person. Although this is not the purpose of this small paper, the compensation amounts are always proportional to the damage caused by improper exposure of the image.

In the case of doctors who have published unauthorized photos of their patients, and as long as there is no intention to cause damage to the patient's image (degrading image), these amounts would be on an average of BRL 10,000.00 (ten thousand reais) to BRL $25,000.00 (twenty-five thousand reais), depending on the peculiarities of the specific case.

At the request of the Direction of “O Folículo” I bring to the discussion the following issue:

In the event that an image is disseminated in an academic environment, duly authorized by the patient and that it has been captured by another person who disseminates it to third parties, is there a claim for compensation from the patient against the doctor?

This is an improper replication of an image authorized by the patient, and the doctor cannot prevent its dissemination by third parties. It would be the same as replicating a photo of a patient found in a book, that is, the patient authorized the doctor, but he cannot prevent this unauthorized replication by third parties.

Thus, I understand that, in this context, there is no way for the patient to sue his doctor, as he is not responsible for the act of third parties.

This is my short understanding of the topic on which I was asked to write about!
