Medical Documentation and Hair Restoration Surgery
Medical Documentation and Hair Restoration Surgery
By Gustavo Graça Mercadante
Due to the Consumer Protection Code (Federal Law 8078 of September 11, 1990), it is mandatory to maintain medical documentation well ordered, regardless of the field of activity in Medicine, under penalty of the doctors facing difficulties in eventual legal disputes with their clients.
It is necessary to point out that the medical documentation is composed of: Patient Records (office and hospital), Service Agreement, Informed Consent Form, and patient photos.
The patient's record consists of anamnesis, clinical diagnosis and a brief description of the treatments and proposed and performed medical acts, chronologically, duly dated, stamped (regional medical council number) and signed by the doctor.
This record can be from the office and from the hospital unit where the surgical procedures are performed; it must contain the surgical description, the medical and nursing evolution, the anesthesia report, and the list of administered drugs; that is, the entire evolution of the patient until hospital discharge.
The Service Agreement is the legal document that shall govern the relationship between the doctor and the patient; it must contain: the qualification of the parties, the description of the contracted services, the detailed values of the fees of the surgeon and team, the anesthesiologist, and the Hospital.
The agreement shall also state for how long the patient will be accompanied by the doctor in post-operative returns and the forecast and costing method for any additional surgery.
The elaboration and signing of this document in detail, with the provisions agreed with the patient, shall avoid disagreements and conflicts between doctors and their patients.
The Informed Consent Form is the document by which the doctors, pursuant to the Consumer Defense Code and the Code of Medical Ethics, provides their patients with all information about the surgical procedures to be performed, their risks, benefits, and complications.
We shall specially mention that the simple absence of information from the doctor to the patient can generate condemnation to the optional treatment, due to the so-called lack of fulfillment of the duty to provide information.
With regard to the patient's photographic record, it is important to highlight that the patient's authorization must be obtained for its realization and for its dissemination in courses and medical congresses (scientific purpose), under penalty of committing an ethical infraction within the scope of the Regional Medical Council, in addition to an action for compensation for the abusive use of this.
I emphasize that the photographs, in any legal dispute with the patient, are an excellent proof of obtaining results, especially when the hair restoration surgery in question is considered by the Judge as “merely aesthetic,” therefore an obligation of result!
In this case, to strengthen the defense, I emphasize that, in all medical documentation, whenever possible, the surgery classification shall be a repair to restore the individual's hair to normality, whether due to an accident / trauma, or either due to illness or due to genetic factors or another cause.
For legal purpose, this classification as reconstructive surgery shifts the doctor's responsibility from the obligation of result to the obligation of means; where the doctor is committed to making available to the patient the whole technique of medical lex art, however without any commitment to the result!
Briefly, these are my considerations on the subject. Keeping the documentation in order will help the doctor to present a consistent defense, in case to be sued by the patient, seeking compensation!
