Dra. Adele Gonzales

Hiring a Hair Transplant Team: Legal means and accounting activities - PART 1
Dra. Adele Gonzales

The main difficulty in starting out in the field of surgical hair restoration is not the technical training, but the creation of the specialized team. There are many questions: do I train my own team from the beginning? How to find the ideal professionals? What is the best hiring regime? How to retain this team, what is the ideal salary, how to give bonuses, and so many other questions.
The purpose of the Management column of this edition of The Follicle is to understand the accounting basis regarding the different ways of managing the hiring of the components of a CT team.
Regarding a subject of high responsibility and complexity, this article will be divided into two parts.
In this first part, we will discuss the possible hiring regimes for surgical instruments, and for this reason, I, Adele Gonzales (AG), interviewed the accountant specialist in the medical field Andressa Krubnick (AK). In the second article, the topic will be intensified with final comments from labour lawyer Dr. Cleidinéia Gonzales and the legal representative of ABCRC, lawyer Dr. Gustavo Mercadante.
Interview with medical specialist accountant Andressa Krubnick
- AG: What are the possible current hiring regimes that are relevant to the operation of surgical instruments?
- AK: To hire a surgical scrub nurse, his situation first needs to be analyzed.
If the scrub nurse is contracted on an exclusive and subordinate basis, he must be contracted through the Brazilian contracting system.
Otherwise, the contracting may be as a service provider, legal entity or even as a self-employed person, considering that the activity of surgical Scrub nurse is not included in the activities of the individual microentrepreneur.
- AG: Legally, what training is required to perform surgery?
- AK: According to the Federal Nursing Council (COFEN), surgical instrumentation is one of the activities of nurses, nursing technicians or nursing assistants, the latter two always under the supervision of the nurse in charge.
- AG: Is there a salary base or floor for this professional in the Brazilian contracting regime? Does it change for each state or municipality?
- AK: As surgical instrumentation will be performed by nursing professionals, they must follow the category's minimum wages.
This amount changes depending on the municipality and the municipality's current collective agreement must be consulted.
- AG: What are the most common mistakes made by employers in this type of contract that make them more vulnerable in the legal/accounting scope?
- AK: The most common mistake when hiring this type of activity is the hiring of a legal entity with employee characteristics.
It is important for the physician to be aware, at the time of hiring this service as a Legal Entity, that there are requirements that cannot be made, such as personality, workday control, and subordination. These characteristics generate numerous labour lawsuits and great concerns for the medical professional.
